The property right in the traditional village protection is an inevitable problem. Because property right determines the boundaries of land housing and the use of arrangements, it shapes the space form to a certain extent, and we must consider the property right when cognizing the evolution of traditional village space formation. At the same time, the property right determines the operational difficulty and economic cost of the planning implementation. it must also be faced directly in the implementation of the traditional village protection measures. From the perspective of property right, this paper explores the process of the formation of the traditional village space form. Also taking Ban Pu in Cicheng in Ningbo as example, it sums up the spatial pattern of the relationship between the different stages of property rights, and puts forward traditional village value cognition method, protection operation method and use management method based on property rights relationship.The main content of this paper is divided into four parts.The first part is the second chapter. This chapter use the relevant theories of sociology to summarize the characteristics of China’s rural property rights. It is concluded that significant characteristics of China’s rural property rights are incompleteness, personality and phases. Incomplete characteristics are expressed in the definition and implementation of rural property rights. Under the traditional environment of "rule by man" in local clan, personality traits in the form of "Clan- property" concept of property rights system. The performance of stage characteristic is transitions of between the symbol of property rights and the legal property rights.The second part is the third chapter. This chapter generally discusses the influence of the property right relation to the traditional village space form. Taking two stages of property right for time clues, this chapter focuses on the role of property rights relationship in different periods on the pattern of the plane. The stage of symbol property right is the formation stage of the traditional village plane pattern. In the practice of "clan property" property rights relationship system, formation of plane pattern includes established space structure, morphological texture unit, Proliferation and fill, and split second. The legal property right stage is the stage of alienation of the plane structure. Texture heterogeneity-- the dissimilation process of the plane pattern of the broken texture--appear in the structure of the two level property right relationship of "collective and family" after land reform.The third part is the fourth chapter. Taking Ban Pu as example, it summarizes spatial patterns of Ban Pu in four stage of property rights: before the city after the village and the spatial structure of the Eastern Zhou Xi Zheng in symbolic stage; morphological gene of the door in the wall; plane pattern of weak Lane from proliferation; the wall door zayuan and ruined temple demolished the temple in Legal property rights stage; the plane of alienation in new and old homes, standing around the courtyard pattern.The fourth part is the fifth chapter. A method for protection and utilization is proposed from the perspective of property rights. It includes controlling plane pattern by cognizing symbol of the stage of the traditional mode of spatial patterns of property rights, repairing texture with the traditional independent property unit courtyard as the operating unit, protective utilization for Ban pu by the introduction of multiple property rights.The paper explains the evolution of the spatial form of the traditional village from the perspective of property rights, and provides a new perspective for environment and its evolution of village space, and proposes the strategies of protection and utilization based on the property right relationship, and provides reference for the protection and utilization of practice.
