Study On The Legal System Of Agricultural Non-point Source Pollution Management In China

In recent years,the rapid development of China's agricultural industry has led to a substantial increase in the level of agricultural economy.However,the ecological environment of agricultural land is in an opposite trend with the development of agricultural economy.Excessive application of agrochemical preparations,random dumping of livestock manure,sewage irrigation,and other unscientific agricultural practices have resulted in a serious situation of non-point source pollution in China's rural areas.Agricultural non-point source pollution continues to intensify,causing serious damage to soil resources and water resources.At the same time,it has triggered a series of chain problems that endanger the quality and safety of agricultural products,human health and safety,and national energy demand pressures.In order to eliminate or reduce agricultural non-point source pollution and chain problems caused by pollution,we must rely on the legal system to regulate a variety of behaviors in agricultural production,control pollutants from the source into agricultural land,and comply with the harmonious development of agriculture and environmental protection.According to the theory of rights,process control theory,environmental justice theory,source governance theory and sustainable development theory,this article uses literature research,comparative analysis and empirical analysis methods to study the legal system of agricultural non-point source pollution management.Based on the analysis of the status quo of China's agricultural non-point source pollution management legal system,we study the problems and causes of the current stage,and finally In response to the problems and causes,proposals for improving the legal system of agricultural non-point source pollution management are proposed.First of all,to explore the basic theories of the agricultural non-point source pollution management legal system,focusing on the exploration of the rights theory,process control theory,and environmental justice theory based on the development of the legal system for the control and control of agricultural non-point source pollution.The basic principles of the legal system of agricultural non-point source pollution management: the principle of consistent rights and obligations,principles of risk management and control,standard quantification standards,and principles of public participation.Secondly,based on three types of typical agricultural non-point source pollution,including agricultural chemicalpreparation pollution,livestock and poultry manure pollution,and farmland irrigation pollution,the current status of China's agricultural non-point source pollution was investigated,and the grim situation of China's agricultural non-point source pollution was indicated.The current status of China's agricultural non-point source pollution control and management legal system is clarified from two aspects: the emergence and development of the system and the specific content of the system.Thirdly,Study the shortcomings of the existing legal system of agricultural non-point source pollution control and problems: the guiding ideology is not clear,the control and control links are incomplete,The main body of management is not strict,the supporting system is not adequate.And analyzed its causes from the perspectives of ideas,agricultural economic types,legislative concepts,and administrative management systems.Finally,based on the theoretical basis and basic principles of the system,it puts forward sound suggestions for the problems and causes of the legal system of agricultural non-point source pollution management: improve the legal regulations for the legal system of agricultural non-point pollution management,strengthen the environmental awareness and legal responsibility of agricultural producers,establish a scientific management subsidy system for agricultural land quality,improve the law enforcement and supervision of agricultural non-point pollution management and improve public participation in agricultural non-point pollution management and so on.
