Construction Of Legal Mechanism Of Marine Environmental Protection In South China Sea Under The Background Of Maritme Silk Road

The political situation in the South China Sea is very complex and cannot be solved in the short term.However,the marine environmental problems in the South China Sea need to be solved urgently.It is necessary for the countries around the South China Sea to shelve the political disputes and to seek ways to jointly cooperate to solve the marine environmental problems in the South China SeaThe South China Sea is an important channel for maritime transport.With the development of the "Maritime Silk Road" strategy in 21th century,the strategic position of the South China Sea as an important channel of the "Maritime Silk Road"will be further enhanced.However,the South China Sea faces very serious marine environmental problems.Although it is one part of the East Asian Seas,which is one of the marine environment plans of the United Nations Environment Programme(UNEP),it has not established its own regional framework convention as other maritime areas.The "Maritime Silk Road of 21th century" has deepened the strategic mutual trust of the countries around the South China Sea,strengthened the cooperation of those countries in the field of marine environmental protection,and provided an opportunity for the establishment of a legal mechanism for the protection of the marine environment of the South China Sea.Therefore,we should seize the opportunity brought by the "Maritime Silk Road of 21th century" to further strengthen the cooperation of the countries around the South China Sea in the field of marine environmental protection in the South China Sea,and speed up the construction of the legal mechanism for the protection of the marine environment in the South China Sea.This thesis first introduces the necessity of constructing the mechanism of marine environmental protection in the South China Sea,and analyzes various severe marine environmental problems in the South China Sea and the problems existing in international law and practice in protecting the marine environment in the South China Sea.Then,through the analysis of the relevant marine environmental protection cases,the opportunities for the construction of legal mechanism for marine environmental protection in the South China Sea brought by "Maritime Silk Road"initiative of 21th century and the legal basis for constructing the legal mechanism of marine environmental protection in the South China Sea,this thesis demonstrates the feasibility of the construction of legal mechanism for marine environmental protection in the South China Sea.Finally,through the analysis and reference of other marine environmental protection models,the construction of the legal mechanism of marine environmental protection in the South China Sea is expounded in three aspects in terms of the legal framework,organization and institutional arrangement.
