The Emission Trading Institution's Problem And Solution

Starting for the 60s of last century,the emission trading theory has brought out by an American economist Dales.Since then,America began to carry out a series laws and regulations,forming a emission trading institution to balancing domestic emissions by economy measures which,not long then,the developed countries start to follow.Recent years,the disequilibrium of our economy,especially those well-developed metropolis has become a pressing issue.Through analysis of the emission trading theory,combine with their own situations,these cities has built up a primary emission trading system.To achieve the legislation goal of emission trading in China,it is a must to discuss the possibility of them.The article here is to analyze the availability and possibility of emission trading institution in China and to promote some suggestions to the system,hoping it will be beneficial to the establishment of emission trading system.The first part will mainly focus on introducing emission trading institution and bring out its significance according to our situation.The legal nature of emission permits has three kinds of "usufructuary right theory","quasi real right theory" and"property right theory" in Chinese law circle,which embodies the characteristics of the public right attribute of emission rights and private rights attributes.The second part will give a brief about the current circumstances and the traits of economic development of China;through an analysis of the case of experimental cities,show out the possibility of such system.Give a comparison between the situation of America in 80s when there is no emission trading institution and our current situation.The third part will give a number of suggestions to the establishment of our own emission trading institution.The fourth part will be the conclusion of this article which summon the significance and positive view of emission trading institution in China.The fifth part is the conclusion of this thesis,the analysis of possible problems in the operation process of the emission trading system in,combined with China's national conditions and reference experiences of foreign countries,puts forward four suggestions,including perfecting relevant laws and regulations,improve the level of science and technology,the transformation of government concept and establish and participate in the program.
