Research On Marine Dumping Legislation In China

Ocean is a huge kind of resource base,which provides rich food and mineral resources to human beings.With the rapidly economic globalization,land resources become too drying-up gradually to meet the demands for rapid economic development.Thus humans begin to seek development of the vast ocean.With oil exploitation and processing,rapid development of maritime transport,humans begin to develop and utilize marine resources at an unprecedented degree,during which period too many people seek maximization of economic benefits at the expense of marine environment.As a result,marine environment suffers serious pollution and destruction.Meanwhile,marine pollution caused by marine dumping is getting increasingly outstanding.China has made great process and development through constant invitation and exploitation in terms of marine dumping management in the past 30 years.China has its own features in the process of international convention on marine dumping,but it still needs being perfected unceasingly.This thesis in the view of legislation,through introducing and analyzing the history of marine legislation as well as successful experience abroad,points out problems in our marine dumping legislation including: low legislative level,poor realistic operability,lagging definition of “marine dumping”,absence of formed regulations and rules,lack of unified legislation and payment rules and others.Suggest establishing specialized legislation in the field of marine dumping to improve legal effect of China's marine dumping legislation.These problems should be confirmed accordingly: definition standard of marine dumping,establishing legal system of marine dumping,and adding cooperation mechanism of international management of marine dumping.Hope these suggestions above can play a positive role in the development of China's legal system of marine dumping.
