Compensation And Treatment Of Environmental Pollution In Closed Public Space

In recent years,with the development of economy,more and more urban population.Large shopping malls,entertainment places,railway stations and other closed public space filled with a large number of public.The pollution of the closed public space environment has become more and more serious,which leads to the damage of many public health.The problem of environmental pollution in closed public space has been paid more and more attention by people.However,China's current legislation on the closure of the public space environmental pollution problem is less,there is no special legislation for the closure of the public space environmental pollution problems.The relevant provisions of the closed public space also more principled,lack of maneuverability,the court in the trial of the new environmental pollution cases only on the basis of "civil law","environmental protection law" and "tort liability law" and other laws,which can not fully guarantee the legitimate rights and interests of victims.Domestic scholars on this issue is still in its infancy,the relevant research results are less,and the United States and Europe as early as 1990 s has begun to develop relevant laws and regulations.Therefore,in the serious environmental situation,should be to study the related issues of public space environment pollution closed in our country,improve the relevant system existing in China,and gradually establish closed public space environmental pollution related legal system.The text of this paper consists of four parts,the first part is an overview of the closed public space environmental pollution,environmental concepts and environmental attributes on the closure of the public space,the type of pollutant characteristics and environment pollution are discussed simply.In the second part,from the characteristics of environmental pollution damage in closed public space,this paper discusses the nature of the liability of environmental pollution tort in closed public space.The third part discusses the closed public space environment infringement,and the closure of the public space environmental pollution damage compensation,the main body,a method of compensation is analyzed.The fourth part mainly discusses the governance problem of closed public space environmental pollution,first in enclosed public space environmental pollution control responsibility are briefly discussed,followed by a detailed discussion on the perfection of public space environment system,finally to construct a closed public space environment system isanalyzed in detail.Including the closed system of punitive damages public space environmental pollution,the compulsory insurance system of closed public space environmental pollution liability.
