The Study Of The National Environmental Obligations Of Promotion

It has been proved that the rights of people about environment cannot curb the environment to the direction of more bad. Scholars become more confused about concepts of environmental rights as the more study on environmental rights. Ecological crisis have the power to destroy the world. It is impossible to stop the damage on environment by personal effect. National effects are needed in protecting environment. Therefore, it is an effective way to solve the environmental problems to explore the depth of the national environmental obligations to protect the rights of citizens’ environment and realize the common prosperity of the environment. The contradiction in current society about environment is that the supply of public products is less than the demand of citizen. The theory of promoting national obligation is based on risk society and welfare state thought. This theory will solve the contradiction in three different aspects. The first, the improvement of the environment is the primary obligation.The second, the increase of environmental public goods is the main means. The third, to increase the environmental well-being of citizens and realize the environmental justice are the ultimate goals. Through the analysis of the existing legislative practice, the practice of law enforcement, and the judicial practice, it is found that position deficiency and negative act are two main problems in performing of governmental obligation. This report will introduce two solutions for improving the promotion of national obligation about environment. The first solution is that define the concept of governmental obligation by lawmaking.The second solution is emphasizing national obligation in positive action. This report will answer the problem of negative action of nation and national relief based on positive law. Finally, looking forward, we will enter the era of national environmental obligations. In this era, big data + national environmental obligations under the guidance of rational, will be a good attempt to coexist with courage and wisdom.
