With the implementation of the new wildlife protection law,the wildlife habitat protection work bring about a new situation.The Wildlife habitat is a particular area of the wildlife survival and reproduction,that is both the double important ecological and social value.Our homeland has vast areas,and the natural environment is too complex,in the meantime,there is rich in wildlife resources.However,Habitat is faced with many problems in our country including severe fragmentation,area decreasing,isolation and quality decline.Resulting in a decrease of wildlife resources and endangered species,consequently,a lot of obstacles has brought in the ecological civilization construction in China.The present-day world,wildlife conservation is increasingly widespread concern of all countries.But at a time habitat protection should be a priority for all.From the practice of foreign countries,national mandatory law and a complete set of effective legal system in wildlife habitat protection play a very important role.The special legal system of foreign countries,for example,the United States,Australia and Japan,both in terms of laws or regulations and in the legal system to carry out the practice,are worth us studying and using.Up to 2016,China has established 2740 nature reserves with the total area of 1 million and 470 000 km2,which covers 14.83%of the land area.Although it has explored the perfection of relevant regulations,the contradiction between protection and utilization still exists.Community development and habitat protection are more like a seesaw battle.It is hard to find the balance mainly because of the lack of high level structured legislation system,undefined concept and the imperfection of local legislation.There exists some problems like the contradiction between community development and habitat protection,insufficiency of public participation,ineffective implementation of environmental impact assessment and low efficiency of management and etc.Based on the promulgation and implementation of wildlife protection law,legislation on protection of wildlife habitat in China ought to abide by the principle of ecology first combined with sustainable use.Since the related legal institutions could be consummated by following aspects:supplementing local legislation,expanding the scope of plaintiff qualification on environmental public litigation,perfecting compensation mechanism of ecological benefits,introducing alternative mechanism step by step,further perfecting investigation,supervision and assessment of wildlife habitat,broadening channels of funding sources and etc.To establish national park system,should be the best choice for wildlife habitat protection in future.
