The Legal Research On Prevention Of Hazy Weather In China

Hazy weather has recently become the most severe,most urgent environmental issue for environment protection and pollution control in China,which is also known as one of the fresh problems. At this period of time, a great number of cities in China have always been assaulted by hazy weather, this kind of extremely abominable weather would not only decrease the rate of traffic visibility, which tends to become traffic hazard, what's more, due to its great pollution to the air, could somehow cause the infection of human breathing system and other secondary diseases, which has already caused lots of Chinese feel scary and horrible about this situation.Due to the problem of air pollution's prevention and control, China produced ?Atomspheric Pollution Prevention Law? to help and ruled several law problems which come out from the procedure during prevention and control. However, hazy weather is fresh environmental problem,The APPL has already defined this problem itself, and has several legal methods for its prevention and control, but the practical situation of hazy weather in China is way more serious and complicated than what is written in the book. Because of a bunch of legal problems which is brought by hazy weather, tend to be complicated and much in quantity, by manipulating specific problems in legislation,judiciary and law enforcement, which has to use the thinking method of advancing with times. On the legal stage, we must do more deep investigation about the legal methods of hazy weather prevention and control, do more to deepen the reforming, explore the new legal methods and ways to adapt recent hazy weather problem, aiming to remit the severe hazy pollution in China.This paper would introduce a great number of different hazy weather spreading data, which is measured in China recently, then take it into analysis and investigation, combine it with the legal methods of air pollution prevention and control at the same time. Try to think about advantages and practial use of these legal methods recently, try to come up with the methods and ideas which are probably adapting to national situation and features of hazy pollution prevention. The true difficulties of data analysis are the facticity,realtime and validity of obtaining data.Facing the legal features and practial implement of national hazy pollution prevention and control, this paper would also like to carry out a way of researching: summarization. The author will make a microscopic analysis about the practial implement of national law against hazy weather prevention and control, then summarize the feature of implement, try to summarize the similarity in preventing and controlling hazy weather, analysis differences, point out some situations which are not that probable during this period at the same time, analysis the disadvantages and flaws in practical implement, so that these legal methods could be more useful in battling with hazy weather in China.Besides, this paper will combine the efforts and experiences of other developed countries in preventing and controlling hazy weather legally with national situation, by the way of comparison, try to compare those real legal cases and experiences of other developed countries abroad with the legal efforts which China has taken, then analysis the developed thoughts and methods which those developed countries have shown, adjust them properly into legal practice of national hazy weather prevention and control, discard the dross and select the essence, try to make sure that these legal methods in preventing and controlling hazy weather can be advanced with times, in order to promote the development and progress of national hazy weather prevention and control.
