Research On Effective Relief About Environmental Pollution Tort

Since the reform and opening up,the process of industrialization and urbanization accelerated,which led to increasingly contradiction between environmental protection and economic development.Starting from the two aspects of environmental protection and judicial relief,environment pollution tort relief was studied in the present article.Systematic analysis was carried out on the shortcomings of the current situation of environmental pollution relief.Moreover,based on environmental regulation and domestic and international judicial practice,some suggestions were presented on improving relief system of environmental tort..Chapter 1 introduced the seriousness of environmental pollution problems.Chapter 2 introduced the concept of environmental pollution,discussed the infringement elements of environmental pollution,and summarized the manifestations and special features of infringement.Chapter 3 analyzed the current situation of environmental pollution tort relief.On the basis of advocating protection of personal,property and environment rights,and combing with actual cases,we discuss the current situation and shortcomings of environmental pollution tort relief by comparative analysis on civil relief.This paper launch the research and discussion on those subjects such as the plaintiff qualification,the evidence acquisition,and the causal relationship.And also discussed the social relief such as liability insurance and environmental protection fund.Chapter 4 combined the characteristics of industry and foreign relief mode.In terms of legislative basis,judicial practice and supporting mechanisms,some specific recommendations was proposed on improving relief system of environmental tort in china.
