Nowadays, china has made a great achievement in economic field, which catch the hole wold’s attention. However,the fast development of economy is on the cost of environmental pollution and ecological damage. The purpose of building a harmonious socialist society require our judiciary to protect the damaged individual rights or interests.Meanwhile,how to find a better way to relieve the damaged right are still in discussion in legal circles,my paper is focus on the discussion of civil remedy.This paper contains four chapters.The first chapter play a role of leading the hole paper,which introduce the conception and characters of environmental tort,in this part i also analyse the basic issues of civil relief in environmental tort. The second chapter is a important part of this paper, i analyse the theoretical basis of civil remedy in environmental tort from five sides,that contains the protection of personal right protection of property right,protection of disadvantage groups,protection of environmental right and the analysis on the theory of law and economics. The main content of the third chapter refer to the the theory and practical experience of civil relief in environmental tort in some developed countries, which may provide some useful reference to structure the system of civil remedy in environmental tort. In the forth chapter i try to introduce the current situation of civil remedy of environmental tort from the sides of extent relative law and the procedure.Base on the analysis of current situation i raise some advances, hope to be useful for structuring the system of civil relief.The last part is the summary of this paper,i express my expectation in civil relief of environmental tort,and i hope my teachers will point out my possible mistakes and provide some useful advices.
