With the rapid development of expressway construction in China, the government departments at all levels have begun to pay attention to expressway maintenance work. From the Fuzhou conference at the end of 1990 s, the highway maintenance operation mechanism began to "custody and maintenance separation, government and enterprise separation" as the focus-depth reforms. After more than 20 years of market practice, we have achieved some experience results, but the reform process is still slow. This paper believes that the basic reason is that the government’s control policy, regulation mode, and the means of regulation, and so on, are lagging behind the market-oriented reform process of the maintenance. And government management tends to intervene directly in expressway under the planned economy in natural monopoly industry in all areas, not well transformed from the past "Commander" role well into "service" role, nor to create an orderly, just the good conservation market operating environment. For this reason, this paper studies the problem of government regulation on the marketization of highway maintenance in our country.Firstly, this paper from a theoretical level demonstrates the objectivity of expressway maintenance market and establishes government control in the maintenance market in scope and control object as well as the regulation. Secondly, we sum up the present situation of the management system and the market oriented government regulation of Expressway in our country, and find the following problems: the management system of expressway "witch hunt" in government in the process of marketization of maintenance management is improper, there is the phenomenon of "vacancy" and "offside", control methods are backward, the laws and regulations construction lag, financial security is not in place, and so on. Investigate the root cause is: ill-defined government functions, benefits and maintenance management of highway when a non-toll road has some applicability in the way of maintenance and management. Finally, through the analysis of the status quo, problems and reasons of government regulation, the paper concludes the maintenance market nature of government regulation essential requirements.Under the background of Chinese economic transformation and high administrative monopoly in highway business links, combining with the essential requirements of the government regulation and the existing problems of the current government regulation, the article constructs a reasonable and scientific path for the reform of government regulation: Clearly define the scope of the government and the maintenance of the market; Accelerate the separation of government and enterprise, and foster diversification of property rights market players; Make rules and policies to ensure sound market system, and put forward the government should make system design top-level system to promote the construction of laws and regulations at different levels; Establish the accountability system of government internal supervision and the introduction of social supervision; Use Internet of things innovation control mode; Expand the source of new conservation funds.
