A Research Of Patent Pool Based On Evolution Game Theory

Era of knowledge economy, patent and its application has become increasingly prominent role in the market competition, and patent strategy also increasingly become one of the core strategy for the companies which seek their own rapid and sustainable development. In order to maintain and enhance their competitive advantage, many companies tend to attack competitors by patent litigation or patent war, snatching patents and making use of them has become the weapons of these companies. Now,in the high-tech industry, the dispute around patents has become more and more serious. Such frequent, interminable patent disputes caused a lot of waste of resources, and hindering the new technology and new standards promotion. So, many enterprises through the formation of patent pools to get rid of patent disputesBased on the existing research results,this paper examined existing patent pools build mode and find related factors that may affect the patent pool built. With related theories, this paper has build a evolution game model of patent pool. By the game model, this paper verified all factors that may influencing patent pool. In the end of the paper, writer chose TDIA as an example to verify his research results.
