The Study Of Rural Land System Policy After The Contracted Management Right Confirmation

The contracted management right of rural land confirmation is an important decision of the CPC central committee’s. Base on the second round contract, the confirmation try to resolve the problem such as: land contract is not consummate, the certificate was not issued, area is not allowed, the border is unclear, spatial location is uncertain. And on the basis of consolidating the rural collective land ownership, try to stabilize the right of contract, and put the right of management into market. Establish of the modern agricultural scale management system in our country. Since the implement of modern China rural land system, it has important contributions to China’s economic and social development.This paper takes the Zhang Fang township of Shang He county of Jinan city as the research sample, record the the process of the contracted management of rural land right confirmation of Zhang Fang. Through system research, unified history and logic, in-depth interview to found the problems and make predictions and suggestions to the orientation of policy of rural land system.This paper is comprised of four parts. The first part of the introduction, include the selected topic background, research significance and the present situation of the current research review, research methods and significance. The second part is to analyze the rural land policy after 1949 in China, mainly experienced: peasant ownership; people’s commune period; collective ownership and family contract system. The discussion offered a historical basis for the rational prediction for the future. The third part is based on the research of the process of the contracted management right of rural land confirmation of Zhang Fang, founding that the officers and grass-roots had a misunderstanding to the policy; the unchanged policy conflict with local policy; land disputes cannot be settled; the leadership of village lack of enthusiasm. After the confirmation Zhang Fang may face the confliction between peasant and collective, the problem of land circulation rate, the problem of utilization of the certificate.The fourth part is basing on the problems, make predictions and Suggestions for the land system, including the right to the contracted management for a long time, the real right, the right to the contracted management guarantee function, establish and improve the system of right to the contracted management of land circulation, stimulate agricultural new operators, set up to exit mechanism of the contracted management right.Land policy is also the national basic policy. The confirmation of contracted management right of rural land right is a milestone during the process of China rural land policy’s self-improvement. After the confirmation, more conflicts may appear in the area of rural land management. Agricultural modernization and scale management should be a long-term goal. How to avoid short-term pain, and achieve the long-term goals, that needs the innovation and practice of rural land managers.
