Research On The Issue Of China’s Fishery Law Enforcement By The Example Of Fishery Law Enforcement Of Chongqing Kaixian

Fishery law enforcement is an important part of administrative law enforcement, it refersto the fishery law enforcement agencies and personnel in accordance with the powers vestedand the procedures prescribed by law enforce fisheries-related laws and regulations,investigate and deal with illegal fishing, and maintain the normal order of production andworkers’ legitimate rights and interests of administrative action, it play an important role forthe protection of the ecological environment and promote sustainable development offisheries. In this paper, I focus on Kaixian fisheries law enforcement presence, for example, tostudy the administrative enforcement of fishery problems and related causes, and furtherpropose improve our fishery law enforcement countermeasures.The first part gives an overview of our country and Chongqing Kaixian fisheries andfishery law enforcement status quo. With the enhanced awareness of environmental protection,protection of ecological environment gradually being taken seriously, the limited nature offishery resources has become increasingly prominent, Therefore, the fishery law enforcementshould be strengthened and more scientific and reasonable, research fishery law enforcementproblems is essential.The second part focuses on China’s fishery lay enforcement issue in detail, Kai County,Chongqing City, the problem of fisheries law enforcement as an example. Fishery lawenforcement problems in the major issues involved administrative law enforcement system,including law enforcement agencies configuration unreasonable, substandard quality of lawenforcement officers, law enforcement equipment is not complete. And administrativeenforcement of content, including the abuse of discretion, administrative penalties are notstandardized instruments produced. And enforcement procedures, including the question ofadministrative penalty procedures used, part of the administrative penalty order problems.The third part analyzes the basic reasons for the existence of the problem of fisheries lawenforcement and puts forward a sound administrative enforcement of fisheries measures, andin order to provide legal support and theoretical support for China’s fishery law enforcement.
