Research On Structure Of The Rural Land Trust Circulation Patterns

The final year of "twelfth five-year" plan in 2015 connects the past and future of China’s economy, a grand goal of our country into a well-off society in an all-round way in 2020 was clearly put forward on the "two sessions". The economy of the vast rural areas of our country is very weak, so there is a long way to achieve this goal. Therefore, developing the rural economy, activating the rural financial market is very important. And promoting the rural land finance is the key lever of Rural financial. The system of common ownership of land is adopted in our country, the farmer has right to use the land without ownership, so land approval is the first priority. On the basis of land approval, farmland financial can be developed through the transfer, mortgage, guarantee, contribution and securitization, and the circulation of farmland is the foundation of all farmland financial instruments.In recent years, the trend of the rural land circulation is more and more obvious, the farmers clamor for the land circulation is more and more high, and the existing way of circulation, such as subcontracting, transfer, lease, exchange, is not able to meet the requirements of the new situation. In the actual flow process, the traditional way of flow has many disadvantages and shortcomings. So the innovation of rural land circulation way has become the urgent task.In order to ensure the rules in the rural land circulation, the trust system of circulation of the rural land contract management right is introduced in this paper, trying to build a mode of rural land trust circulation to promote the long-term development of rural economic, replacing the traditional way of land circulation. Rural land trust circulation system can speed up the improvement of traditional agriculture, vigorously promote the pace of agricultural modernization; can safeguard the rights and interests of farmers and increase farmers’ income; can significantly reduce the transaction costs of operators, so as to improve investment returns. Most importantly, the combination of trust system and land circulation has the advantages of financial attributes, On the one hand, issue trust unit financing for the trust project from capital market to develop the land. The land contract and management rights as the trust property, on the other hand, regenerate the land capital and land income receipts can be negotiable, mortgage financial products, innovative farmers financing way.Related literature about rural land trust circulation pattern in our country is not much and the research is inadequate, pilot work only implemented in a few places of China, the rural land trust circulation patterns are studied systematically through typical case analysis in this paper. Firstly is the introduction of related concepts of rural land trust circulation, then starting from the current situation of the development of the rural land trust, analyze its feasibility, it is knowable that most of the rural areas in China have or close to the standard of rural land trust circulation. Then combined with the domestic first single land circulation trust-suzhou city, anhui province land trust mode of case study, analyzing its operation mode key, found the advantages and disadvantages, and operation mode for reference to build accord with the actual situation of China’s rural land trust circulation mode. Furthermore by using the experience of land trust operation mode at home and abroad, basic mode, supervision mechanism and financial support to build, conceived of the feasibility of land circulation patterns. Finally as the conclusion and prospect part, at the same time, the mode of supporting system gives countermeasures, including improving the rural social security system, perfecting the relevant laws and regulations of land trust, land approval agencies, trust of land registration, land evaluation, etc.
