Research Of Guangxi Environmental Pollution Liability Compulsory Insurance

In recent years,the problem of the global environmental pollution is more and more serious,fog haze and other bad weather have gradually caused serious harm to people’s body and mind. With the constant improvement of legal system,people gradually have the consciousness of tort liability of environmental pollution, which bring about environmental pollution liability insurance received the widespread attention. In2008, our country began to engage in environmental pollution liability insurance in Jiangsu, Hunan, Hubei,Henan, Chongqing, Shenzhen, Ningbo, and Shenyang, but the work did not achieve expected results. Guangxi province be seated in the west of china and the economic development is relatively slow,which hindered the development of environmental pollution liability insurance. Study of environmental pollution liability compulsory insurance in guangxi is very urgent and of great significance.First of all, this paper collect some researches about the compulsory insurance and environmental pollution liability insurance form domestic and foreign,and the connotation and function of environmental pollution liability insurance are described in this paper. Secondly, the paper has studied the experience of the United States, Sweden, Germany,Britain, France and other western developed countries operating environmental pollution liability insurance, and also has analyzed the state of operation form the provinces of at begining of operating environmental pollution liability insurance------Guangdong, Hunan, Hubei, Hebei and Jiangsu. Based on those researches, this article analysis the operating conditions of environmental pollution liability insurance and the main reason of the huge gap between at domestic and foreign, and points out the worth learning of practice experience. This paper has pointed out the risk exposure of environmental pollution which mainly concentrate upon heavy metal pollution, Marine pollution and solid waste pollution in Guangxi, and analyzed the regional distribution of these high-risk industries.Finally, reference other countries’experience and characteristics of Guangxi which include environmental risk exposure, operating conditions and the distribution of high-risk enterprises and others, the paper have studied the following main aspects of environmental pollution liability compulsory insurance:the role, function and requirements of insurance main body (government, the underwriter, insurant); the design principle and the notes of Content (insurance coverage, liability limit and deductible, validity of a claim, premium); environmental liability compulsory insurance types,various supporting mechanism and so on.
