Land-losing Farmers’ Rights And Interests Safeguard Mechanism In The Process Of Urbanization

With the advancing of urbanization,the demand for land is increasing,a large number of agricultural land surrounding the cities has been expropriated into non-agricultural land. Without land, these farmers lose their job and the traditional sense of the farmer,and are excluded from the urban residents, get to the edge of the group. This problem is becoming more and more outstanding, and has seriously affected the social stability and the realization of fairness and justice. There fore, deep researching in the problems of the land-lost farmers’ interests, seeking the effective measures to safeguard the rights and interests of land-lost farmers, building the feasible rights and interests safeguard mechanism, are important for the harmony and stability of the society, and playing a important role for the long-term development of the country.On the basis of Marx’s theory of land, draw lessons from western theory of property rights, according to China’s practice, this paper expounds the urgency of improving the safeguard system of land-lost farmers’ rights and interests. The paper explain the meaning of the mechanism of protecting land-lost farmers’ rights and interests,establishes that the mechanism should include the system of compensation for lost land,the reemployment mechanism,the social security mechanism,legal aid mechanism,and present that the protecting mechanism should base on the theory of coordination and operation,form an organic system exchanging energy with other part outside. And then, this paper analyzes the situation of land-lost farmers’interests protection mechanism in the progress of urbanization in our country. The paper concludes the defect of land-lost farmers’interests protection mechanism on the basis of land expropriation system,land compensation system and legal aid mechanism.Through the deeper social investigation,the paper analyzes the land-lost farmers’interests protection mechanism of Handan city for empirical analysis,and draws a conclusion that the policies system of the government is very clear,but the effect of actual operation at the grass-roots level is not significant. The government is ineffective, the level of compensation is too low and issue is not timely,and the land-lost farmers are in a weak position,they can’t express their intention,these problems show that the the land-lost farmers’interests protection mechanism of Handan city is not effective.The basic reasons are that the compensation system is deficient,the government is ineffective,and there is no way for farmers to express their intentio。To the commonness and individuality problems of the land-lost farmers’rights and interests safeguard mechanism in China,the paper puts forward the corresponding countermeasures and suggestions:deepening reformof the rural land,improving the mechanism of rural land expropriation; improving land-lost farmers’compensation and legal aid mechanism;Reinventing government role;building land-lost farmers’actionable mechanism.
