Study On The Problems Of Loss Of Compulsory Automobile Liability Insurance In China

Compulsory automobile liability insurance was purposed on July1,2006.It has been practiced for nearly eight years. As the first insurance of legislation enforced. It fully embodied the "people-oriented" concept, and it also protected interests of the motor vehicle road accident victims. China’s compulsory automobile liability insurance system established relatively late, it is still in early development, its system construction is not very perfect, it has a serious loss problem currently.This thesis includes the following sections:The first part is the introduction, mainly explained the background of the study and practical significance of the thesis, the goal of this study and research methods. The second part is overview of the compulsory traffic insurance system. It explained the concept of the compulsory traffic insurance. It analysis the compulsory traffic insurance’s feature, introduces the social relief fund system and moral hazard, in order to make the readers can understand this system. The third part is the present situation and the analysis of losses of the compulsory traffic insurance,it introduces the process and the development situation of the insurance system from set up to now, the problems of compulsory traffic insurance in inplementation and the analysis of losses of the compulsory traffic insurance.The forth part is the analysis of the questionnaires, in view of the situation of our country insurance loss to design questionnaires, and to understand the basic situation and to analyze the reasons, which is the cause of loss of the compulsory traffic insurance. It sums up some proposal to perfect the compulsory traffic insurance of China by consulting the research result of some the related theories. The fifth part contrast the features the compulsory traffic insurance of Taiwan areas. And then, it summed up instruction to perfect China’s compulsory traffic insurance. The sixth part are measures, including business model, insurance coverage, supporting system and so on. Hope that that measures can perfect the compulsory traffic insurance. The seventh part is conclusion.This paper introduces the compulsory traffic insurance system. By consulting the research result of some the related theories, the thesis put forward that five kinds of main factors affecting the loss of Compulsory Traffic Insurance in China, these main factors are the current insurance system, the cost of injury compensation, the management of insurance company, the moral hazard factor, the social factor. This paper use open-ended questionnaire to prepare the questionnaire of the factors about the loss of Chinese Compulsory Traffic Insurance based on literature analysis. This research extends1000questionnaires, which recovering798valid questionnaires. The paper draws the conclusions on the basis of analysis of questionnaire data.Therefore, this study put forward suggestions from four ways on the basis of the above findings. First is to innovative business model, and improve our country’s insurance business, promote the transformation and upgrading of insurance based on our country Taiwan area management model. Second, regulators should strengthen propaganda and punishment, improve the insurance rate. Third, the insurance company should manage scientifically, improve service quality, and alleviate the pressure of the insurance business. The last is completing the system of relief fund, expand the scope of the source of the bailout fund, perfect the bailout fund management institutions. To establish perfect compulsory traffic accident liability insurance system so as to promote the road traffic safety and to play its social functions and responsibilities of protecting human life and health to adapt to the rapid development demands of China’s society and economy.
