The "NBA Lockout" In The United States And Its Enlightment To The Labar Relations In The Field Of Professional Basketball In Our Country

In 2011, the "NBA lockout" and "collective bargaining" in the United States have become two hot topics in the field of global sports. "NBA lockout" means the United States Basketball League to suspend the situation because the collective bargaining agreement is not reached. This paper systematically sorts out the repeated lockouts in NBA history, analyzes the main mechanism to resolve the NBA lockout and then dissects the main problems in the area of labor relations in the development of China’s professional basketball based on the theory of labor economics and through the methods of utilizing relative documents, interviewing experts, case study and comparative research. Based on the analysis above, we have drawn conclusions as follows:l."NBA lockout" reflects the labor disputes in the development of American professional basketball. The labor relation in American professional basketball is the relationship between the economic interests of both employers and employees in professional sports. Employers, including professional basketball leagues and professional basketball clubs, are mainly responsible for the capital investment to unions and teams and maximizing profits through the market of professional basketball competition performance. Employees, includes professional basketball players, their brokers and the players’union. The players’union plays an important role in the labor relations of American professional basketball. Its main purpose is to safeguard the legitimate rights and vested interests of professional players. On behalf of the players, it conducts collective bargaining and interest game with the employers in order to get right, salary and benefits for the players.2. After a long period of development and improvement, there has been a more mature mechanism to settle the labor disputes in American professional basketball. It contains the mechanism of collective bargaining, labor dispute mediation and arbitration and legal lawsuit. Among them, collective bargaining mechanism is the main means and method of regulating labor relations in the development of American professional basketball. If collective bargaining fails, it will introduce the labor dispute arbitration mechanism and legal lawsuit mechanism. The labor disputes arbitration mechanism usually has a relevant authority as a mediator or arbitrator to bring the two parties to adjust to each other’s interests and needs. Legal mediation mechanism is that the employers and employees adjust themselves respectively under strict rules. This complete set of mechanisms for resolving labor disputes ensures the long-term development of American professional basketball.3. Though the history of the development of China’s professional basketball is very short, there have been some disputes about labor relations. As professional basketball develops, especially in the case of more and more foreign players joining the CBA, we need to learn from the United States NBA to resolve labor disputes so that the labor relations in the development of China’s professional basketball can embark on a standard and ordered road.Based on the conclusions above, combined with China’s specific condition, This paper puts forward three recommendations:First, we need to transform the functions of government, to modestly reduce the administrative intervention in professional basketball and to accelerate the substantiation of association. Second, we need to establish and improve the laws and regulations of professional sports as soon as possible, including laws and regulations about labor relations in professional sports to make it reasonable and ordered in the development of China’s professional basketball.
