Study On Legislative Problems Of Maternity Insurance

The maternity insurance is one of a social insurance that the states or the governments protect women who are at the term of pregnancy, delivery and post-delivery from health effects and salary losses that are caused by medical costs and work break. Maternity insurance is made of three parts: maternity vacation,medical service and pension. Maternity insurance is an important part of social security; it helps to promote society and family’s stability, and promote the harmonious development of society. Maternity insurance ought to be borne by government initially. Then it was developed to be borne by enterprises. In the reform process, the problem of the maternity insurance policy is increasingly prominent. In addition, some enterprises often escape from giving maternity benefits or even refuse to pay the maternity insurance fee under the huge market economic pressures, in order to reduce the economic burden. Therefore, the new and old problems during the implementation of the maternity insurance policy are going to exist for some time.I study our country and the foreign country’s maternity insurance modes and analyze them from the types and effects of maternity insurance, also the rules of maternity leave and parental leave. Then I get the inspiration to eliminate work discrimination, to enlarge coverage range and to reduce the burden of enterprises.Considering of the current problems of maternity system in our country and the policy of the 13 th Five-Year Plan, I suggest combining the maternity insurance with the basic medical insurance comprehensively. Formulate the Urban Employees’ Basic Medical Insurance Regulation and the Urban and Rural Residents Basic Medical Insurance Regulation which cover the maternity insurance. And I also make some suggestions on the defects of the current maternity insurance system.
