The family planning policy has been adjusted three times up to now. After the18th to thethird plenary session, the “second child alone” will be carried out, but the specific regulationsdid not come. China’s politics, economy and culture have made great changes. It is worthattention, the number of urban population was more than the rural population in2011, sowhether the new birth policy reform should also be implemented as soon as possible? Whywere there different fertility policies in urban and rural areas, were these reasonable? To solvethe above problems, the background of the policy, policy makers, market economy, fertilityculture and the role of the population should be analyzed. The rationality of family planningpolicy is elaborated from the right to live. when the right to live get to be guaranteed, theprotection of individual right to development should be strengthened.This paper elaborates the background formation of the policy and analyzes the status quoof these factors, in order to give some reference to the current fertility policy adjustment.The source of this topic is mainly elaborated in the introduction part, the brief summaryis carried out through the domestic scholars on the research achievements. And put forwardthe basic research ideas.The first part, the transformation from the determination of the family planning policy to“one child” policy and establishment of the urban and rural policy on birth control isintroduced in detail. In addition, the urban and rural policy on birth control is expounded indetail.The second part, the cause of formation of urban and rural policy on birth control isexpounded from the policy makers, the practice of market economy, the concept of fertilityculture and the number of population.The third part, the urban and rural policy on birth control is analyzed through theJurisprudence. The theoretical basis of family planning is discussed from the right to life.In addition, the factors that affected by fertility policy execution are analyzed frompopulation, the market economy development level, the family planning policy and fertilityculture.Finally, the implementation effect of the urban and rural birth policy is analyzed. At thesame time, the agreed view is put forward based on many scholars’ view.
