This article studies the missing and maintenance of students’ rights in the teachingprocess. To achieve students’ development is the important aim of teaching. So if we want toachieve the purpose of “students’ centered”, we have to respect and safeguard students’ rights.Students are in the process of growing up, they have not only the rights that common peoplehold, but also the rights that students should have. To study the students’ rights during theteaching process, we can’t treat students as the shorten form of adults. They should beindependent individual according to the law and the actual situations. Therefore, on the basisof clarifying the fundamental concepts of students’ rights, this article analyzes the phenomenaof the missing of the students’ rights in the teaching process and give some related advice onthe safeguarding of the students’ rights. This article is divided into four parts:The first part is the introduction. It Mainly explains the research background, researchstatus, research contents, research methods and significance. The students are immature, thestudents’ right should be paid more attention, but in real situations, the students’ rights areoften subjected to various abuses. In this paper mainly uses literature, the right to observe thestatus quo and interviews several research methods in the teaching process enjoyed byeducators to maintain the rights of students with important theoretical and practical in the realteaching, research work value.The second part studies the process of teaching elementary school students the right tothe basic concepts and theoretical issues. Children’s rights include: the right to life, the right todevelopment, protection and participation rights subject. Pupils belong to the category ofchildren in the study process, we based on the characteristics of students and the rights of thecontent structure, the right to elementary school students enjoyed the teaching process isdivided into three development rights, liberty, and the right to communicate. Positivedevelopment is a positive change, everyone has need of development, may also havedevelopment, so development must be a fundamental right of students; freedom is theinevitable requirement of individual existence, people to get full development would need tobe in a free environment, so as to achieve a fair and impartial; communication is an inherent requirement of individual development, people are social life, once you leave the exchangeand communication, people will not be called a man. These three students in the teachingprocess rights are key to achieving effective self-development, students should clear theirright to enjoy, but also to learn to use reasonable means to achieve the maximization of theirright to enjoy; as a teacher not only to clarify the rights enjoyed by the students, to workharder to maintain and achieve these legitimate rights of students.The third part studies the missing of the rights during the teaching process in elementaryschools. Lack paper discusses the process of teaching elementary school students the right todevelopment, the right and freedom of communication such as the right to enjoy, and theircauses and other issues, the missing of the students’ rights restricted the student’s overallhealthy development on a very large extent.The fourth major research-related measures in the teaching process is to protect students’rights. These measures include: strengthening the rule of law, enhance the legal awareness ofteachers and students, is the basic guarantee to protect the rights of students to achieve;actively create favorable conditions to protect the right to development, development ofstudents. The freedom to create a relaxed and comfortable learning environment is the key tostudents from a strict discipline required to develop a classroom atmosphere; create aharmonious learning environment, maintaining students’ communication rights. Harmoniouslearning environment including good physical environment and spiritual environment, andcreate a harmonious learning environment, to build a harmonious relationship betweenteachers, students communicate effectively safeguard the realization of the right; play to theadvantages of the teaching process, respecting the autonomy of the students. In the teachingprocess, teachers by teaching content, teaching methods, teaching ideas and other reforms toensure the effective realization of student autonomy; enhance students’ awareness of theirrights. Student’s awareness of the rights of students to fully enjoy the benefits ofself-awareness and freedom, it is inevitable that the requirements of social progress, but alsoimprove the quality of the student’s own internal requirements. To enhance students’awareness of the rights will not only protect their own interests but will keep them frominfringing the legal rights of others.
