Research On Legal System Of Rural Medical Security

The rural medical security system, which is an essential part of the rural social security system,plays a vital role for the long-term development of the rural economy and even the national economy.Moreover, this system is both important for the improvement of the life quality of peasants, and isimportant for the stability of the Chinese society. Therefore, it is necessary to analyze the shortcomings andcauses of the current rural medical security system from an institutional perspective. What’s more, it is acompletely new topic to construct a clear and effective law of the rural medical security system.The law of the rural medical security system, which is a basic part of the social security law, isstill in its starting phase. The executive effect of the rural medical security system is restricted by theproblems in the legislation, which needs improvement. The Third Plenary Session of the18th CPC CentralCommittee proposed the goal of the integration of rural endowment and medical insurance into urbanwelfare system. And the proper integration in the target means the amalgamation of the rural and urbansocial security system by administrative force. The General Office of the State Council released theOpinions of the State Council on Establishing a Uniform System of Basic Endowment Insurance for Urbanand Rural Residents in21Feb.2014, which explained and regulated the uniform system of basicendowment insurance of the urban and rural areas. Recently, it is of urgent importance to redesign the ruralmedical security system from an administrative angel.This thesis mainly studies the execution of the rural medical security law, and analyses thecurrent rural medical security system from a legal perspective. The paper not only analyses theshortcomings of the system, but also proposes the way to complete the rural medical security system whichbases on the study of the international experience. Furthermore, the thesis adopts both the theoretical andempirical approach, and it consists of five chapters. Chapter one introduces the rural medical security lawsystem generally, and analyses the basic concepts, system changes and the structure of the rural medicalsecurity law. Moreover, this part discusses the necessity of bringing the medical system into law. Chaptertwo explains the logical basis of the rural medical security law, that is, survival right, social justice andsocial relations. Chapter three analyses the maladies affecting the rural medical security law and points out the existing problems, such as, the deficiency of the system, low level of the legislative body, lack ofeffective administration and the compensation system. Chapter four refers to the rural medical security lawsystem experience of both developed and developing countries, and compares the rural medical securitylaw system with the USA, Japan, Thailand, Brazil and India. After analyzing the differences, the paperproposes a compulsive way of collecting fees, the construction of the medical system in depth and benignpaying system design. Chapter five discusses the construction and completion of the rural medical securitylaw system, analyzes the legislative principles of rural medical security law and the position of thegovernment function, and brings up suggestions about the redesigning of the current system.This thesis points to the problems in the implementation of the rural medical security law system,which is based on facts, and puts forward many tentative ideas in several aspects, such as,the constructionof a multi-level medical security mode, the position of the government function and the compensationsystem. These original suggestions may help the completion of the legislation of the rural medical securitysystem.
