Non-Competition System comes into being with the economical development whichlimits the employees’ free choosing right in order to protect the business privacy ofemployment party. Non-Competition System plays a important role in the protection ofbusiness privacy of employment party and maintenance of market order. But it should benoticed that Non-Competition System limits the right of employees, probably hinders theprogress of science and technology and hampers public interest.Non-Competition System involves the different interests, of which the conflictbetween employment party, employees and public interest is most important.Regardless ofbusiness interests, or the interests of workers, or the public interests of the society are allworthy of legal protection.It is right to restrict different interest to a reasonable extentwhen some laws are acted. In the first part of the thesis author explain the concept,classification and characteristics of Non-Competition System and analyse the conflictbetween different interests.In the latter part of the find a lot of problem in the Non-Competition System stipulated in labor contract law, and give some advice on amendingthe current law by reference to comparative laws.
