The Legal Research On The Trust Model Of Securitization Of Credit Assets

Assets of credit card, also known as credit asset-backed securities(referred to as "credit ABS"), which has developed very rapidly in our country in recent years, and the relevant systems and regulations have changed especially after the 2012 restart pilot. I will tightly bound domestic credit card assets of the practical operation which were studied in recent years, hoping to make relevant useful insights.In this article,firstly I will analyze the basic elaboration of the securitization of credit assets,including analysing the concept and system value, practice and legal structure.Secondly I will analyze the legal effect of the type of asset securitization trust issues, including the independence of the problem of credit assets, problems of special purpose vehicle seting up,meanwhile I will expound the rights of the principal and the comparison of credit enhancement methods.Thirdly, I will analyze the current limitations of the trust benefit card, protection of the rights of interests of the trust beneficiary, problems of inadequate information disclosure, and so on. Finally, I will solve front of all sorts of problems,combining with the practice of the securitization of credit assets of recent years operation and current registered legal environment,to propose the corresponding perfect legal system of securitization of credit assets.
