On Legal Issues In New Rural Construction Environmental Protection Plan

With soaring development of social economy, our national urbanization comes into a fast promotion period. According to the data, urbanization rate as of 2014 has reached 54.77%, and it shows that our rural population has been continuously immigrating to cities. During the course, the feature of emphasizing city construction while neglecting countryside construction emerged, and it caused spontaneity and randomness in countryside development and construction activities. The specific embodiment includes the layout of rural residence area and industrialization and intensification industry area is casual, the infrastructures are outdated, the living supporting facilities are scanty, and the landscapes and the traditional villages are losing their original appearance. These issues result in destroy of rural environment and giving rise to environmental pollution phenomenon, which has seriously affected the realization of aims and requirements of “production developed, life abundant, rural custom civilized, village appearance clean, and management democratic” for socialist new countryside construction, as well as held back sustainable development in our rural area and even throughout the country. Therefore, it is before everything that we should enhance rural environmental protection planning and prevent the environment from destroy and pollution. However, our national laws on rural environmental protection planning are lagged behind, and it could not meet the requirements of new countryside construction.Based on current study, this article mainly focuses on reasons why our nation emerges these rural environmental protection planning issues from the legal angle, and it proposes a series of targeted solutions and suggestions. This article firstly analyses the new countryside construction and the environmental protection planning, as well as the relationship between them. It illuminates the significance of environmental protection planning to new countryside construction. Starting from this point, it then reveals the roots which caused environmental pollution and environmental destroy via puncturing the realistic issues and law issues of new countryside environmental protection planning. Then in consideration of the roots, it analyses why the environmental protection planning issues occur in rural area viewed from the legal angle, such as providing rational thoughts and mining in four main aspects including legislation, law enforcement, environmental assessment interaction and supervision, and law planning consciousness. Next, it analyzes what could our nation learn from foreign countries’ good environmental protection planning experience. At last, concerning the legal reasons mentioned above and learning from the good experience, it proposes corresponding resolutions for perfecting laws on our rural environmental protection planning, in order to realize sustainable, healthy and humorous development of rural economy and environment.
