Theory Of Jail In Pending Status And Operation In The Process Of Custody

The detention center is our country legal places of pretrial detention. It is an important part of criminal proceedings. The detention center has always belonged to the management of public security organs in China. Extorting a confession by torture, jailhouse bully, extended detention, the lawyer meeting with difficult issues in the detention center attract scholar, media’s attention. The critics of the existing system to advocate the detention center neutrality and attacking the existing management system, requiring the implementation of the humanized management can be constantly found in the newspaper and journals. Scholars of criticism and suggestions are very sharp and prospective. Majority views are from the perspective of reform in pretrial detention. On the existing mechanism and working direction of detention center involves relatively less. The author has long been engaged in the management of the detention center. I have the responsibility to reveal the true state of the detention center’s work through theoretical and empirical analysis method.The article consists of three chapters:Chapter One elaborates on the definition of detention center and pretrial detention. Firstly, it clears the definition of the detention center, its history and nature. Secondly, it defines the definition of the pretrial detention, its nature and purpose. It lays a solid foundation for the next chapter discusses.Chapter Two focuses on the status of the detention center in the process of the pretrial detention. It analyses the task and function of the detention center and exposes the essence and status of it. Firstly, it clears the detention center’s task, which is to ensure the smooth progress of the criminal proceedings and protect the legitimate rights and interests of persons in custody. Secondly, it describes the functions of the detention center, which is custody, education correction, digging crimes and punishment. It paves the way for the arguments of detention center’s hot issues in pretrial detention process in the next chapter.Chapter Three pays attention to the operation of the detention center in the process of the pretrial detention. Firstly, it introduces the operation principle of the detention center. Secondly, it puts forward two hot issues of the detention center in the process of the pretrial detention. They are the neutrality of the detention center and humanized management. It analyses the neutrality of the detention center from the positive and negative points. In the concluding, it relies on the system to solve the problem of the neutrality of the detention center. But at present, only from the institutions continuously perfect can be close to the target. Finally, it puts forward only the implementation of the humanized management and strict management is the way of management of detention center.
