| With the development of economy,the food safety standards are raised to a higher level.However, from the perspective of the current situation,quite few food on the market could satisfy the demand of keeping healthy for the costumes.The food safety accidents outbreak so frequently,and part of area even happened more intense.Solving the problem of the food safety cannot be waiting.Undoutly,building a food safety protection mechanism needs the whole society’s endeavors.But criminal law regulations can not be vacant when the moral education, civil and administrative sanctions are not sufficient to improve current situation.lt is very necessary to take penalty measures to punish criminals and solve the serious problems of the area of food safety.Based on this, research how to play the full role of criminal law in the regulation of food safety crime is the focus of this paper.This paper is divided into six parts.The first part is current food safety issues.l will analyze the harm of food safety criminals based on the serious cases in recent years,and clear the necessity of criminal law on food safety crime control.The second part is analyzing the status of food safety crimes.Expounding the connotation of "food", "food security" and "food safety crime" and put up the characteristics of food safety crimes through investigations.The third part is the judicial application of food safety status.I will propose the problems on punishing food safety crime based on the typical empirical analysis and case analysis.The forth part is the short of the criminal law on the control of food safety crime. Analyzing its lacking from the perspective of legislative model, constitute a crime, the punishment setting and malfeasance crime category of the food safety.The fifth part is studying some benefits of other countries’ criminal laws on food safety controlling.The sixth part, put up the measures of punishing food safety crimes from the legislative, judicial perspective. |
