In today’s society, with the rapid development of tourism, the tourism has been an important industry which can impact the lifeblood of countries’economy. Tourism administrations and relevant organizations of individual countries attach more and more importance to the requirements of the tourism spots, so the well-planned tourism plays a large part in promoting the respective economy. China has been developing tourism into a strategic pillar industry since 2009. Through a long-term preparation and verification, China issued Tourism Law of the People’s Republic China in 2013. As a vital part of tourism, tourism spots play a necessary role in the development of tourism. This paper starts discussion from the joint point of the Tourism Law and spots tourism, presents an overview of the relevant home and abroad researches and continues further discussions based on the overview. I adopted the local Giant Wild Goose Pagoda as the study case; and this paper used various methods to further investigate the requirements of the Tourism Law to tourism spots, which includes literature research, questionnaire survey, comparative analysis method, case analysis, quantitative analysis method and qualitative analysis method.The legislative purpose of the law is people-oriented and the principles of the law consist of four principles:symmetric powers and responsibilities, using market mechanism, sustainable development, and comprehensive legislation. The paper cites the items of the law to explain, and further discusses the benefits of the issued law for Chinese tourism industry. And then the paper comes to the requirements of the law towards the spots tourism. First, the paper introduces the law items of the chapters in the Tourism Law; Second, the paper analyzes the relationship among the six interested parties:the governments, tourists, travel agencies, tour guide, other tourism operators and the drivers of the tourism buses; Third, the paper further discusses the resources protection, spiritual civilization, service level and the consumers’ rights of the spots tourism under the tourism law. Under the Tourism Law, the paper proposes six requirements for the spots tourism:the opening conditions, the management of the tickets, the operating rules, operating permissions, several liability and the tourism safety.Taking the tourist city Xi’an, the famous humanistic tourism spot Giant Wild Goose Pagoda as an example, the paper studies the practice of the Tourism Law of the People’s Republic China. The paper presents an overview of the Giant Wild Goose Pagoda spot’s tourism resources, spot scale and ancillary facilities, and provides detailed instructions of the current management and operating situation of Giant Wild Goose pagoda. Through the analysis of present tourism situation of it, the paper points out five aspects problems consisting in tourist behaviors, the charge of ticket and other projects, space capacity of tourism spot, standard management of service and safety protection.When the Giant Wild Goose pagoda tourism spot thoroughly implements the Tourism Law, attention should be paid to understand the public service of public resources tourism spot and lead the tourists to cultivate positive consumption concept according to the requirements of the Tourism Law. And the bureau should maintain the sustainable development of the Giant Wild Goose Pagoda out of the resources protection. The Tourism Law states that further efforts should be paid to improve the ticket, space capacity of spot, tourism development and the management of tourist behaviors, and more detailed requirements should be raised in the operating and maintenance, information,tourism safety and so on. The spot should pay attention to the complaint-handling, quality standard level, and service management, and protect the legal rights of the consumers so as to improve the service quality of the spot.The tourism spots have complex management systems and are managed by varied organizations, so it becomes necessary for tourism spots to implement the requirements of the Tourism Law. The law itself is not perfect enough; the spot itself also lacks of initiative and hasn’t implemented thoroughly. On the whole, when the spots implement the Tourism Law, the guidelines are that the spot should place more emphasis on environmental carrying capacity, develop in a reasonable way and pay equal attention to the development and protection. The price should be controlled in a reasonable range and the spot should create fair competition environment. The spots should perfect the marketing and create the unique tourism brand. They should also implement the Tourism Law and solve the problem of tourism spot price management. It should develop into a service oriented tourism industry to enhance the competition capacity. Under the regulating of the Tourism Law, the paper looks forward the development direction and development cores that the spots should perfect itself with the development of the tourism so as to offer better service experience for public tourism.
