The Study On The Video-recording System Of Interrogation

The system of video-recording in the interrogation is the embodiment of the concept of human rights protection in criminal proceedings.The system of video-recording in the interrogationcan decrease the abuse of the power of investigation in a certain extent. It also has a great significance on conduct investigations and preventing force confession. The system of video-recording in the interrogation originated in the trail implementation of the Supreme People’s Procuratorate in 2005. With nearly a decade of development,the system of video-recording in the interrogation gradually spread in the public security organ and procuratorial organ comprehensively. The Article 121 in "Criminal Procedure Law" of China in 2012 stipulates the content of the system of video-recording in the interrogation, which is the first reflection in the form of law. Chinese system of video-recording in the interrogation comes into a new stage of development. However, our system of video-recording in the interrogation still exists many problems in practical. It also lacks of explicit specification operations and responsibility procedures, which makes it difficult for the system implement and can not give full play to its value function.In this paper, the existing problems in practical of the system of video-recording in the interrogation in our country are reflected. And some opinions and suggestions are put forward to improve the system. This thesis is divided into five parts. The first part briefly introduces the history of video-recording in the interrogation. The second part discusses the evidence attribute of video-recording in the interrogation. The third part analyzed the value and function of video-recording in the interrogation. And the last two parts is the core part of this paper, which contains a detailed analysis of the main problems in the system of video-recording in the interrogation in the judicial practice of our country at present. It proposes many useful advices related to this proposal.The full implementation of the system of video-recording in the interrogation will inevitably faced with the problem, but in the context of the protection of human rights, we should continue to promote the reform of system of video-recording in the interrogation. With more accumulated practical experience, the system of video-recording in the interrogation will be developed in further.
