Concerning The Improvement Of The System Of Network Freedom Of Speech

In China as early as in the constitution stipulated in article 35 of the citizens have the right to freedom of speech, at present, freedom of speech with the help of the realization of the network platform has been more broad, at the same time also brought certain negative influence to the society. In the Internet age, how to balance the interests of all parties, in the protection of citizens’ right to free speech under the premise of restrictions on freedom of network to carry on the reasonable, improve the system of good network freedom of speech in China, this paper begins.Is the first part of the article, from the Chengdu women drivers case introduction, analysis of the connotation of network freedom of speech and the existing problems, puts forward the deficiencies in China’s legislation on Internet freedom of speech:the legislative level low, imperfect legislation, focus on restrictions on Internet freedom of expression and ignore the protection of it. The second part mainly from three aspects discussed the reasons of network freedom of speech problem:because of ignoring the particularity of network speech; Second, due to the lack of special laws, government regulation too tight; Three is because the network freedom of speech and reputation, privacy and intellectual property rights conflict. The article third part respectively from two aspects of legislation and judicial practice of the United States and Germany, analyzed their network of free speech similarities and differences in legislation and judicature, to provide reference for the legislation and judicial practice in our country. The fourth part put forward the Suggestions of perfecting our country’s network system of free speech:first to perfect the legislation, expand public participation and improve the legislative level; Secondly, the specific content of law should be improved and based on our country’s specific national conditions and the characteristics of the network to strengthen the protection; Finally, in order to strengthen the construction and management of the industry.
