Research On The Regulation Of Users’ Speech By Network Social Media

With the change of Internet technology and the popularization of intelligent terminals,online social media has become the infrastructure for citizens to exercise their right to freedom of speech.There are boundaries in the exercise of any right.The negative effects caused by the abuse of freedom of speech by Internet users must be regulated.The technical advantages of online social media can make up for the lack of government regulation resources.The government has set up a legal obligation to require online social media to bear the responsibility of regulating users’ speech and make it become the actual manager of speech in virtual space.The regulation of users’ speech by online social media improves the regulation efficiency and alleviates the pressure of the government,but the operation of the mechanism still has the following problems: first,the excessive public law obligations increase the tendency of social media to restrict users’ speech excessively,and the lack of clear institutional standards hinders the compliance construction of the platform;Secondly,in the actual regulation process,the power of social media is lack of constraints,which mainly reflects three aspects: the monopoly of discourse power in formulating regulation rules,the weak procedural constraints in the implementation of regulation,and the abuse of algorithm technology to destroy the order of speech communication.Users’ rights such as freedom of speech and property rights are not guaranteed;Finally,law enforcement departments carried out "special rectification" actions to urge social media to fulfill their legal obligations.The distribution of responsibilities was unbalanced,and there was a lack of attention to the process of platform governance speech.The opacity of administrative interviews may lead to the unreasonable closure of speech communication channels by social media,which indirectly restricts users’ freedom of speech.In order to reasonably regulate the regulation of social media and reduce the risk of improperly restricting users’ freedom of speech in the regulation process,this paper puts forward corresponding improvement suggestions for the problems existing in the regulation:first,administrative legislation should distinguish the nature of users’ speech,reasonably set the legal obligations of the platform in combination with the characteristics of platform technical regulation,and improve the illegal information reporting system The standards of supporting systems such as auditor access system standardize the compliance construction of the platform.Secondly,in order to reasonably restrict the regulatory power of the platform,we should introduce user representatives and industry organizations to participate in the formulation of regulatory rules under the guidance of the government.Establish a user participation decision-making system and give full play to the supervision function of users in the judgment of illegal speech.Build a multi-layer freedom of speech relief system,including the government and judicial organs,to ensure that users can get sufficient relief,while deterring the platform to prevent their abuse of power.Introduce professional institutions to supervise the application of social media algorithms,improve the rationality of algorithm technology operation and reduce the negative effects of algorithm technology on speech communication order.Finally,the government should pay more attention to the process of platform governance,jointly establish a dynamic illegal speech information database with the platform,unify the speech judgment scale,and timely intervene in areas that cannot be touched by the platform,such as governance of closed speech space.At the same time,we should further promote the openness of the interview process,establish the interview information disclosure system,invite multiple subjects to participate in the interview,and promote the rationality of the rectification results,so as to ensure the normal operation of the infrastructure of freedom of speech.
