The development of organic agriculture is one of the main trends in the current situation of agricultural pollution.The development of organic agriculture in western countries started earlier, and the corresponding legal system is relatively mature and perfect, The development of organic agriculture in China is quickly since the 80 s of the 20 th century,but the law has many problems, such as directly related to organic agriculture law only "organic product certification management approach", it is only with organic food certification but, we can’t take into account all aspects of organic agriculture, in the "agricultural law", but stressed that from a macro point of protection and development of agriculture, and in the "environmental protection law" is only focused on the environmental problems caused by industrial pollution protection, environmental protection of legal system of agricultural pollution involved is very weak. Constitution, natural resources protection law and other legal departments, the relevant legal system is not perfect, the law enforcement in the process of law enforcement is not strong. In view of this reality, in the legislation established complete legal framework, should be improved from the aspects of ecological compensation, clean production, agricultural insurance, tax regulation system, in law enforcement to intensify law enforcement is imminent.
