Therefore, for child abuse behavior,it should be given strict regulation. But in real life, child abuse phenomenon frequently in the press, the prohibition of child abuse phenomenon, an important reason is that in our criminal law for child abuse, there are some shortcomings in regulating. A lot of child abuse behavior eventually are SINS, intentional injury through abuse, insult to convicted and punished, stir-up-trouble crime and other crimes, although also can have certain effect to punish, but there are a lot of improper application of law and lighter punishment, therefore, to perfect our relevant provisions of criminal law, police path is imperative to explore a reasonable child abuse, in order to forcefully to the rights and interests of children’s all-round protection. In this paper, in reference to foreign about regulation, on the basis of an effective way for child abuse, further study of the present abuse behavior regulation path choice. Academia at present, in our country, there are two views, one is a separate set up the crime of child abuse, another is a kind of perfect the related regulations of abuse. Both regulatory path each have advantages and disadvantages, but in terms of real effect and the feasibility, perfect the abuse has more advantages, it can not only realize to the full range of children’s rights protection, also can maintain the stability of the legal authority and tolerance. Through to the crime of abuse of perfect, effective regulation of child abuse, sufficiently powerful safeguard the legitimate rights and interests of children and healthy growth, safeguard social fairness and justice.
