Male 60, female 50 years of age(55 for female cadres) legal and emeritus age since established in 1978 has been in use today. However, along with the upgrading of economic structure, education cycle lengthened, laborer to work time late, combined with our country population life expectancy prolonged, endowment insurance fund operation pressure, to make ends meet trend is obvious. Under this background, our country promote the reform of legal system of retirement actively, the academic arguments for reform. The author will discuss how to perfect our country’s legal system of flexible retirement.The article adopts the method of empirical analysis of the study, analyze the exploration of flexible retirement legal system in Suzhou for nearly 10 years, this paper analyzes advantages and disadvantages in stages, confirm flexible retirement necessity, feasibility and urgency of the legal system with specific data, as the national legal system of the legal retirement reform experience and lesson.Through an empirical analysis of the Suzhou explore, to put forward the legislative Suggestions of flexible retirement system finally. On voluntary and compulsory, classification set, the combination of scientific legislative principles, based on the specific put forward: 1, strictly limited and phasing out early retirement; 2, to the minimum, the highest legal and emeritus age; 3, delay the women’s retirement age step by step; 4, according to industry, post classification set retirement age; 5, confirm the overage laborer and unit of choose and employ persons to establish legal labor relations.
