Our Death Penalty System Of Human Rights Protection Under The Vision Research

With the protection of human rights in modern sport booming, China’s death row inmates have been attracted more and more attention from public. Applying the death penalty to China which is in the first ranking about death and capital offence number in the world, how gradual abolition of capital punishment in accordance with international trends, how to make reservations condemned human rights in the case of moderate to retain the death penalty system is the system of the future development of our country which will face the death penalty as an important issue. This paper, as a starting point to exist our death penalty system, comparing with the difference between the death penalty and the applicable of international standards, noting the gap between China and the international standards of human rights protection situation in our country, making recommendations on improving the protection of human rights of those who will face the death.This paper is divided into six parts, the first part is an introduction; the second part describes an overview of the death penalty, death penalty system under the perspective of human rights and human security relationship, then the death penalty system under different academic perspectives to analyze the analysis and comparison of the death penalty waste views reflected in the protection of human rights were analyzed and summarized. The third section discusses the status quo through the evolution of China’s death penalty system under the context of the vision of the death penalty and human rights protection system, the analysis of the death penalty system in the presence of human rights protection vision problems. Part IV discusses the current situation and analyze the development mainstream foreign countries apply the death penalty in the protection of human rights. And the specific legislation applicable to death in foreign countries to protect the human rights embodied analysis, and then explore its value to the death penalty in the Criminal Code applicable human rights protection. The fifth section discusses strategies and suggestions to improve the Death Penalty in China in terms of human rights protection system concepts, technology and substantive law. The sixth part is the conclusion.
