| Based on "water pollution prevention plan among the Huaihe River, Haihe River, Liaohe River, Chaohu Lake, Dianchi Lake, the upper reaches of the Yellow River (2006-2010) " Shanxi Province Government Office issued reformation on cross-section of the surface water quality eco-compensation mechanism,and it began in the same year. In the implementation process, Shanxi Province made further supplemented and improvement on surface water quality eco-compensation. In recent years, Shanxi Province surface water quality eco-compensation policy has become a relatively mature institutional framework and achieved series of implementation effect. However, policy has its limitation, a long-term Basin Environmental Governance needs higher rank legal documents. In 2014, the party’s eighteen Fourth Plenary Session adopted the document on "CPC Central Committee decided to advance the rule of law on the overall number of major issues", In this paper, effective policies to be legalized and interact between policies and laws were put forward. It undoubtedly pointed out the direction for Shanxi Province watershed eco-compensation system. Under this context, this paper uses an empirical way to analyze the necessity and feasibility of Shanxi Province surface water quality eco-compensation legalization of policies. Finally, we propose series path thoughts to promote Shanxi surface water quality eco-compensation legalization of policies.The introduction present the analysis background on Shanxi Province surface water quality eco-compensation legalization of policies.The first part of the article analyzed the institutional structure and implementation of Shanxi Province surface water quality eco-compensation policies. Through analyzing the implementation of policies and institutional structure effect, Shanxi Province surface water quality eco-compensation policy has formed a relatively complete system and achieved a brilliant short-term effect. Through analyzing the policy content and the canonical form, the article put forward that the legalization of Shanxi Province surface water quality eco-compensation policies should take steps forward from specification text converting to text on the basis of legal norms.In conclusion, the article concluded the above opinion and bring forward let ecological polices legalize. The proposed eco-compensation policies and laws of the legislative ideas for eco-compensation legal system construction in Shanxi Province and the country are of great importance.Finally, part of the "Postscript" analyze and predict the legislative trends on Environmental Resources in China. Through analyzing the current legislative situation of environmental resources, the article think that eco-compensation legislation will be the focus areas for future environmental resources legislation. The newly revised "Legislation Law" emphasizes the law effectiveness and the technical of legislation. Under this background, legalization of policies that the legislative model will play an important role in the eco-compensation legislation. |
