Local Government Authority Listing In China Problems And Countermeasures Of The System Construction

In the national governance structure, governments under the Party′s leadership is the primary governance body.Deepenning the reform of the administrative system and the transformation of government functions, in order to play a better role of government in promoting the market play a decisive role in the allocation of resources, is the key to the modernization of national governance through institutional innovation.Establishing a list of power system and improving the relevant supporting facilities, training of the system of the government at all levels of consciousness, is conducive to improving the ability of the government’s overall governance, to the construction of the rule of law,the introduction of public supervision of the new channels of government behavior, is helpful to clarify the boundaries of power and responsibilities,and enhance mutual trust between the government and the community,.Futhermore,the release of market vitality can improve the government’s overall governance capabilities.The implementation of the power list system is an era of building outstanding governments. through the clearing and confirming of the existing administrative power, all the reserved powers(special security power except), need be open to the public.The construction of a power system list, is an appropriate combination between the central government’s top design and local governments’ s multiple exploring.The starting point of this paper is to explore the role of power list system for the governance of the government and the realization of the modernization of national governance. This article discusses the basic principles and practical significance of the power list system. By analyzing the typical case of power system construction in Zhejiang Province, the paper summarizes the main difficulties in the implementation of the power list system, and then discusses the causes of the problems and puts forward the corresponding countermeasures.This paper argues that the main reasons for restricting the power list system of local government in our country: first, the legal basis for the formulation of the power list is not unified, there are differences in interpretation; the two is the binding force of the list of powers is not rigid, the actual legal effect exists; the three is the right and responsibility list is not equal, the four is the formulation of the power list after the implementation measures are not perfect.The specific measures to improve the system construction of local government power list include:(1) according to the principle of power to clean up and determine the power list;(two) the establishment of the power list operation supporting system;(three) the dynamic long-term management mechanism;(four) effectively promote the system of power inventory to expand the contribution of citizen’s political participation.
