As the last line of defense to prevent violations,The criminal law should play its due role in the protection of food safety.This article analysis the current situation of food safety crime in China and abroad on food safety crime criminal legislation via choosing the judicial practice of food safety crime in criminal legislation, and on this basis, put forward our country food safety criminal legislation perfect suggestion. The details are as follows:Firstly, analyzing food safety legislation and criminal judicial applicable plight of our country. At present, the "food safety law", "criminal law" and other food safety laws and regulations are inadequate,does not adapt food security and China’s social development, and then bring the plight of judicial protection of food safety.Secondly, In the food safety law USA, Germany, Japan and other countries were selected respectively as research object, analyzes the legal provisions of these countries and sums up the relevant legislation in our country in the field of reference, so as to provide experience for the perfection of the criminal protection of food safety in china.Thirdly, From the criminal classification system, criminal law, penalty and so on,I analyze the existing legislation of our country’s food safety crime problems,such as the charges set up a simple, punishment does not adapt, crime form and the lack of a single qualification penalty.Finally, in view of the above problems, I put forward some reasonable suggestions on the criminal protection of food safety from the criminal classification system, food safety criminal law and penalty etc.
