With the progress of mobile information technology and the popularity of smartphones, tablets and other wireless devices,companies are getting increasingly attention mobile commerce market. At the same time, the marketing mode are becomeing interactive type that more attractive to consumers. In recent years,QR code commercial application used to commercial marketing by companies in a variety of commercial applications.Becauce it differents from the conventional traditional marketing.So the use of trademark presents many new ways and some potential trademark infringement are also emerging. Initial interest confusion of trademark has become increasingly prominent.And it will inevitably affect the trademark protection under the QR code commercial application.Therefore, at the time of the rapid development of China’s information and marketization, it is necessary to analyze initial interest confusion theory and strengthen trademark protection under the QR code commercial application. In order to ensure the healthy development of the new commercial applications. The first chapter briefly introduces QR code commercial application and summarizes the common use of trademarks and potential forms of trademark infringement under the QR code commercial application. This chapter emphasizes that the main confusion is the initial interest confusion. The second chapter focuses on the effect of the QR code commercial application for the identifiy of trademark infringement.And this chapter also describes the related content of initial interest confusion theory. The third chapter summarizes the present situation and problems of trademark protection in China. At the same time, this chapter put forward the proposal based on the theory of initial interest confusion.
