Legal Stipulations Of Product Liability Related To Enterprises Owned By Foreign Capitalists In China

With the deep development of global economic exchange,the role of enterprises in international economic and social life is gradually changing,the value assessment of enterprises has been gradually transformed from benefits maximize before to social responsibility.At the same time,with the continuous development of science and technology,a product can be produced,exchanged, circulated,consumed and used among several countries,which making cross-border product liability cases increasing.In recent years,the constant occurrence of product liability cases related to enterprises owned by foreign capitalists,makes the attention rate of product liability cases related to enterprises owned by foreign capitalists rising gradually in domestic.Now,60% of Chinese export products are made by enterprises owned by foreign capitalists,so enterprises owned by foreign capitalists in China should bear the responsibility to protect and improve the quality of products.Through a comprehensive survey of theory and practice, this paper analyses the current situation and defects of product liability related to enterprises owned by foreign capitalists in China,and according to comparison with the legal stipulations of product liability related to enterprises owned by foreign capitalists in foreign countries,the author put forward his own suggestions,and hope that the suggestions can play a guiding role for enterprises owned by foreign capitalists in China and consumers to protect their legitimate rights and interests better.Except for the introduction and conclusion, this paper is divided into four parts.The first chapter,though the introduction of some product liability cases related to enterprises owned by foreign capitalists in China in recent years,briefly comment on the current situations and focus issues of product liability related to enterprises owned by foreign capitalists in China.The second chapter concretely introduce the types of legal liability caused by product defects of enterprises owned by foreign capitalists in China,including civil liability,administrative liability and criminal liability.The third chapter,according to comparison with the legal stipulations of product liability related to enterprises owned by foreign capitalists in foreign countries,find out the significance of reference to our country.The fourth chapter analyse the defects of product liability related to enterprisesowned by foreign capitalists in China, the author put forward his own suggestions for colleagues to criticize.
