The Research Of Improvement On Community Correction System

China’s community correction system starts late and the development is not mature, but since the beginning of the pilot in 2003, China’s community correction system has acquired many achievements. In 2013, there is a discussion on improving the community correction system in the field of theory and practice after the system of China’s reeducation through labor was abolished. As a concern for human rights in light punishment correction mode, the community corrections are recognized by the public. In this paper, we make the China’s community correction system as the object and use the empirical and comparative analysis methods, and then try to put some thoughts on legislative, judicial, law enforcement and other aspects based on an objective analysis of the development status and problems.The framework of this paper consists of five chapters. First of all, the basic theory of community correction system, primarily to analyze the concept, rationale and value-oriented perspectives and Related Concepts; secondly, the analysis of community correction system in Europe, America, Japan and Hong Kong and other countries or regions of the theory type and mode of development, and then elaborated the significant references on China’s reform and community correction system; On this basis, to clarify the concept of community correction system, clarify the development process of Community Corrections, and then to analyze the opportunities and issues facing our country at this stage of Community Correction System. Through the Comprehensive analysis, the defects and deficiencies exist in our community correction system mainly reflected in following areas: firstly, there is a deviation in the idea, Attention to a sentence of imprisonment and neglects non-custodial sentence, as the same as the conception of emphasis on admonishing and neglects punishment, is very clear. Otherwise, principles and guidelines of community correction system has not been established; Secondly, the legal system including community corrections legislative level, application objects and measures, institutional settings, law enforcement personnel, evaluation system and so on, is not fully developed. We try to provide some ideas and directions for improvement through analyzing the targeted problem. Finally, specific ideas to improve our community correction system: to develop a unified community correction Act; to optimize community correctional institutions; to set up and expand the scope of Community Corrections applicable objects; to improve the team and build a sound evaluation system. The purpose of this study is to build community correction system which is socialism with Chinese characteristics.
