The Supervision System Of Province People’s Council In Vietnam

2003 "people’s Council and Committee Organization Law" provisions of the people’s Congress has decided to place important functions and supervision of the implementation of the provisions of the resolution, the higher, the status and role of the Vietnamese people in recent years, the continuous improvement of parliament. Provincial People’s Congress is the most important part of the local people’s Congress, is the core of the people to exercise their right of supervision. But in recent years with the development of economy and society, the provincial people’s Congress System in Vietnam has been unable to meet the objective requirements of the supervision of the masses of the people. In reality, because the relevant laws and regulations are not perfect, imperfect supervision mechanism, internal division of labor is not clear, not clear, standardized degree of supervision and the actual effect and the people are expected to be far apart. So the research present situation, the provincial people’s Congress supervision of the existing problems, and the measures to improve the necessary, has the important theory significance and the practical significance.Provincial People’s Congress supervision is one of the most important powers conferred by the constitution. Supervision of the provincial people’s Congress in a very important position in the whole national power supervision system. Parliamentary system itself is concerned, the provincial people’s Congress supervision should follow the principle of legitimacy, continuity and timeliness principle of supervision, implementation of the constitutional value of parliament supervision, safeguard the rights of citizens. In operation, the provincial people’s Congress supervision includes the people’s government at the same level and its constituent departments, court, procuratorate staff of state organs and the by election or appointment, supervision by the vote of confidence, special inquiry etc. In reality, the provincial people’s Congress supervision because of lack of legislation, specific supervision consciousness representative is not strong, the lack of supervision of the actual effect. In order to improve the supervision of the provincial people’s Congress of Vietnam, this paper draws on institutional basis and political basis and Vietnam are similar Chinese local people’s Congress supervision experience, put forward specific recommendations to improve two aspects from the system construction and personnel training, to the provincial people’s Congress supervision can guarantee the implementation of the constitution, the law, the protection of the legitimate rights and the interests of the citizens.Research on central Vietnam Congress Supervision, lack of supervision of the provincial people’s congress. In this paper, through the theoretical analysis of the provincial people’s Congress Supervision, improve the supervision system of specific proposals. The author hopes that the study can promote the provincial people’s Congress supervision and deepening the function research, to further strengthen the supervision of the provincial people’s Congress supervision effect, help accelerate the process of constitutional government of Vietnam.
