The Study Of The Supervisory Function Of China’s Local People’s Congress

The functions of China’s National People’s Congress have been improved greatly andvarious institutional creations have appeared in the recent years, which illustrate that our socialdemocratic constitutional construction developed deeply. The most important point is that therights of People’s Congress’s supervision have been expanded and much progress has been madein the supervision. However, there are still discrepancies between the task and the function.Therefore, it is necessary that theories should be paid much more attention. Although manyscores of studies and researchers have been achieved, they are not adequate. Accordingly, wepick up the functions of supervision of China’s local National People’s Congress as startingpoints to make an analysis and exploration of theories and practices systematically in full detailby means of combination of prescription and exemplification, aiming to position the institutionof People’s Congress reasonably.After extensive survey, we have found that the reasons why the supervisory functions oflocal People’s Congress do not work well that the rights of supervision have not been put intopractices and the organization constructions of supervision are not sound.Therefore, this research includes four chapters and analyzes the ways of improvingsupervisory functions of local People’s Congress from three respects. First, construct an effectivesupervisory system to realize the functions of supervision. Second, strengthen organizationalconstruction of local People’s Congress. Third, find the other ways from the outside of People’sCongress to change the functions better. For example, try to find out which factors are muchbetter to enhance the functions of supervision. Discuss the interaction of ministerial party andPeople’s Congress emphatically. Finally, we make a more positive and rational expectation forthe function of supervision of local People’s Congress.More specifically, in this study, there are four levels to explore the supervisory function ofChina’s Local People’s Congress. In the first chapter, explained the basic theories of thesupervisory function, that the constitutional theory of the Local People’s Congress, theconnotation and scope of functions. In the second chapter, discussed under the supervision of theactual operation of the Local People’s Congress in China, and analysis of the factors that affectsupervisory functions to achieve in the political practice, the reason why the Local People’s Congresses supervisory role has not been achieved, in addition to the National People’s Congress,the Chinese Communist Party and government relations in the current political system does notstraighten out, the construction problems are: First, the Local People’s Congresses and theirstanding committees, monitoring instruments and institutional arrangements, lack of integration;organization and personnel of the Local People’s Congresses at all levels, not well adapted to therequirements of the National People’s Congress supervisory function. In the third chapter, theactual case demonstrates the existing problems in the implementation process of supervisoryfunctions of local people’s congresses in China, which is the main content of the study. The finalchapter, specific measures to strengthen the oversight functions of Local People’s Congresses inChina to achieve.This research tries to create institution concerning the supervisory research of People’sCongress. For example, base on the constitutional politics, analyze about different extents oflocal People’s Congress functions, bring up constructional model, explore the breakthrough oflocal people’s representatives and discuss the effectiveness of younger, more knowledgeable andmore professional members of standing committee of local People’s Congress and specialcommittee. We hope that this research facilitates to deepen the exploration of supervisoryproblems of People’s Congress, strengthen the supervisory functions and push the steps of ourconstitutional constructions.
