In a modern society that features mass production and mass marketing, how to ensure the legitimate rights of consumers has become one of the core issues of national development.If the rights of consumers are effectively protected, it will bring benefits to both individual consumer and the country’s economy. But when nations of the world are just focused on promoting economic development, they usually give a variety of economic benefits to enterprise due to significant economic effect. Because of this, the concept of consumer protection is relatively weak. But along with consumer issues that happen constantly, the country’s economy has been seriously hampered. At the same time, more and more consumers realize the importance of their rights. These reasons force them to raise consumer protection issues to the national development strategy.The Internet, logistics, and transportations are well developed in the 21 st century, which make the trade between countries even more frequent. And in the framework of the WTO, more and more countries establish system such as Free Trade Agreement(FTA) with other countries that can eliminate tariff and non-tariff barriers. In the market environment which is full of fair competition, consumers can buy cheap but high-quality foreign products, but there is a risk that the rights of consumers are infringed if there are defective products. Therefore, more and more countries have begun working on consumer protection system.Since China and Korea established diplomatic relations in August 24, 1992, trade relations between the two countries have been developing rapidly, China has become Korea’s largest trading partner and largest export market, while Korea will become China’s second largest trading partner soon. China and Korea concluded a FTA in June 1, 2015. This means that the two countries will gradually open all of their markets except for sensitive areas such as defense, security to other side. Free Trade Agreement will further promote bilateral economic and trade relations between China and Korea, but at the same time, how to effectively protect the legitimate rights and interests of China and Korea consumers is important issue to be resolved. In recent years, a growing number of Korean scholars have been studying China’s consumer protection system, but on the contrary, there are few Chinese scholars studying Korean consumer protection system. I believe that both China and Korea need to understand the other country’s consumer protection system to ensure the legitimate rights and interests of consumers in China and Korea, because China and Korea’s market will combine into one huge market in the future. Moreover, China and Korea have some similarities not only in the history and culture, but also in the economic development process, and both countries belong to the civil law system. It is worth mentioning that Korea established consumer protection system earlier than China, and Korea introduced consumer protection system in developed countries on the basis of compliance with national conditions. Therefore, for China, it is worth referring to Korean consumer protection system.This thesis is divided into three parts as followingsChapter 1 is the basic history of the consumer protection legislation between China and Korea. First, I introduced separately the basic history of the consumer protection legislation between China and Korea, and on this basis, I made comparative analysis on consumer protection legislation system between China and Korea.Chapter 2 is the comparison of China’s Consumer Protection Act and Korea’s Consumer Protection Act. First, I introduced separately China’s Consumer Protection Act and Korea’s Consumer Protection Act from the perspective of substantive law. And I comparatively analyzed the relevant contents between them in each section.Chapter 3 is the several thoughts and suggestions on improving the new China’s Consumer Protection Act. In this part, I analyzed the new China’s Consumer Protection Act’s several hot questions at an angle of Korea-related laws.
