With the development and prosperity of China’s financial market, financialconsumption disputes more and more frequently,but the rights of the consumers arevery difficult to get timely and effectively relief.Therefore, based on the perspectiveof bank consumer non-litigation relief,focuses on the analysis of the bank consumerdisputes in China non litigation relief mechanism, and on the basis of foreignexcellent system put forward concrete suggestions, so as to provide convenience forcustomers to resolve dispute timely and effectively, and to achieve all-roundprotection for consumers.This paper is divided into three chapters:The first chapter of bank consumer disputes in non litigation mechanism andexisting.This chapter firstly introduces the advantages of non litigation reliefmechanism in the Bank of consumer disputes,and then from the reconciliation,mediation, administrative complaint, arbitration and other aspects are introducedproblems of bank consumer disputes non-litigation relief mechanism, and analyzes itsreasons.The second chapter foreign bank consumer disputes in non litigation mechanismand its enlightenment. By introducing the FOS mechanism of British, Australian andJapanese, the reform of financial supervision USA,FIN-NET of the EU, and providethe reference to perfect the mechanism for the right bank consumers in China relief.The third chapter perfect bank consumer disputes in China’s non litigation reliefmechanism. This chapter embarks on consumer rights protection in the whole train ofthought, and puts forward some concrete suggestions on Mechanism of non litigationrelief, including negotiation mediation mechanism and financial system, perfectingthe administration guarantee mechanism, the establishment of cross regional disputesettlement network platform, and the supervision of the news media, so as to facilitateconsumer rights,and realize the financial consumption dispute resolve. |
