A Study On The Effect And Strategies Of International Convention On The Safety Of Fishing Vessels To Chinese Survey System Of Fishing Vessels

The influence of International Convention for the Safety of Fishing vessels is referred to as SFV Convention, which is the only technology treaty designed by the international maritime organization for fishing vessels. At present, the international maritime organization is increasingly promoting the implementation of the convention, the Chinese government is actively considering joining the convention, and the government had begun to actively look at the domestic current situation of the fishing vessel legal inspection, also had taken measures to improve the current situation of the fishing vessel inspection legislation and enforcement in China.Because the legal system of fishing vessel inspection needs to be improved, the law of fishing vessel is not perfect which will inevitably affect the fishing vessel enforcement under the pressure of the convention. The thesis is divided into three parts study the influence on the fishing vessel inspection in China and how to deal with the new situation that the convention brought in legislation and law enforcement.Firstly, the thesis simply described the present situation of fishing vessel inspection in our country, and detailed analyses of the survey of fishing vessels,then studied the law system of the fishing vessel inspection and existent problems in our country. Now, our country has established a fishing vessel inspection with Chinese characteristics. The legal system of fishing vessel inspection has provided a legal basis for enforcement work. Meanwhile the fishing vessel inspection management has also been gradually improved. But as the international and domestic situation changes, legislation and law enforcement of the fishing vessel inspection gradually exposed some problems, which need to be improved.Secondly, studying the influence of the SFV convention to the fishing vessel inspection in China. The convention is both an opportunity and a challenge for our country. The convention represents the latest trends on the legislation of the fishing vessel inspection. The convention is beneficial to promote our legal system of fishing vessel inspection and provided a reference basis. At the same time, in terms of law enforcement the convention will help improve our fishing vessel inspection work. Also it can promote our fishing vessel inspection work process more openly and transparently, and improve the quality of the fishing vessel inspection personnel. In addition, the convention will have effect on China’s pelagic fishing.Thirdly, put forward several suggestions on how to deal with the challenge that the convention brought. On the one hand, improving our country’s legal system of fishing vessel inspection, updating relevant domestic laws and regulations, and strictly reforming the fishing vessel inspection management practices. On the other hand, to improving the supervision system of fishing vessel inspection, promoting the construction of fishing vessel inspection institution, strengthening the training of fishing vessel inspection team, and raising the level of supervision and administration.
