The Parolee Management Reform Under The Perspective Of Community Correction

Conditional release is a very important penalty execution system in the world. In some of the western countries with execution socialization deep into the heart, the application of conditional release is more sentenced than abatement form penalty, and even in some countries only conditional release are kept, but abatement from penalty. At present, in most of the countries through the world conditional release management are carried out through the form of community correction. Because of the legal concept, legislation, society and other aspects, conditional release ratio was very low in our country, only about2%, and tended to decrease year by year. In our country the public understanding of community correction is very limited, and many people think that the existence of conditional release system is only for the rich or those with power which is mainly due to the long period of insufficient supervision to the parolees, in which situation."Conditional release" becomes "unconditional release" and their behaviors are not constrained. Unstable factors to the society multiply a lot. From the beginning of2003China’s community correction institutions take charge of the parolees. Although it has been eleven years of implements, compared with developed countries, community correction in our country is still in the initial stage. Under the background of national implementation and social management, strengthening the community correction power in our country is gradually strengthened, but the system of parolee management system in our country is still not completed, such as laws and regulations are not sophisticated, supervision duty to the parolee was in vacuum, surveillance way was sole mode, technology was not fully used, education support did not reach to the designated position, and public participation was insufficient in make full use of system implementation is not in place and the lack of public participation etc.. So, in the framework of community correction system, study on China conditional release system in-depth, is of great significance to promote our country’s reform of the parolee management system.The author takes the theory of community corrections and conditional release as the starting point, through the analysis of H District parolee community correction situation in Haikou City, Hainan province, points out our country’s parolee management problems, and analyzes the reasons that cause these problems, puts forward some specific ideas with the hope of perfecting our parole system by learning from the advanced experience of management at home and abroad.The innovation points of this paper are:1. The parolees are researched independently from the four kinds of community correction objects;2. Combined with China’s parole management practice, proposes the systems and measures in the process of parolee community corrections.
