Study On The Legal Problems Of Public Utilities Franchise

It was the third Plenary Session of the18th Central committee that cleared the key point of comprehensively deepening reform. The most important part of the reform is the system reform in economic aspect. What the economic system is confronting with are the problems on the comprehensively advancement of market economy in all sectors of economy. They can be abstractly summarized as the problems of balancing the roles between government and market in economical operation. At the same time, the reform of public utility became a hot issue again and was paid wide attention by the community. As an efficient method for the privatization of public utility, franchise is widely used in the reform process of public utility among regions in China. Since the public utility franchise sprung up in1986, the role government played in public utilities has changed and optimized over the nearly30years’ reform, from a participant to a director. We have made full use of market economy to prove the development of public utility. The privatization of public utility has optimized the allocation of our resources and the efficiency of industry has been promoted.The franchise for public utility has broken the combination of enterprise and government and has created a more orderly environment for public utility. It has changed the situation that public utility enterprises’ poor efficiency and slow update techniques.Nowadays, the public utility reform exists everywhere in our country, while the imperfect legislation hinders the process in some degree. Therefore, it is of great importance to establish a better public utilities franchise related legal system. Since1986, China began to sprout the franchised management of public undertakings, nearly thirty years of reform from government plays in the utility role in changing, from the participants to guide optimization. Make full use of a positive role in promoting the development of the market economy, the reform of public utilities, privatization of public utilities is to optimize the allocation of resources in China, the utility industry to enhance the overall efficiency. By multiple comparison and analysis, a more clear understanding of the legal obstacles of our country Public Utilities Franchise, and puts forward the countermeasures and suggestions to improve the accuracy of our Utilities Franchise legal system. In this paper, through longitudinal combs our country public utilities reform process, comparing the world practice, method, comparison research method, historical research method, literature analysis method and case study method of Public Utilities Franchise legal system are studied using logic analysis, tries to put forward questions, found that the problem, the research context to solve the problem of China’s need for Public Utilities Franchise legislation reality.
